Servient estate
A servient estate (also known as servient premises or a servient tenement) is an area, or parcel of land that has a burden attached to it, i.e. an easement. An easement is a right which a person has over land owned by someone else. A burden that runs with the land regardless of who owns it is known as an ‘easement appurtenant’.
The servient estate provides a use that is of benefit to another property (known as the dominant estate) such as a right or way or access to utilities.
